Welcome to CreatorVision. By accessing or using our service at app.creatorvision.io ("the Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is owned and operated by Pink Llama Creative LLC ("Company", "we", "us", or "our").

If you do not agree to these Terms, you must not access or use the Service. By creating an account or using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Description of Service

CreatorVision is an AI-powered video analysis platform designed for content creators. The Service analyzes publicly available videos from YouTube, YouTube Shorts, TikTok, and Instagram Reels to provide insights including:

• Hook and opening analysis
• Visual language and editing patterns
• Pacing and narrative structure
• Thumbnail effectiveness
• Platform-specific optimization suggestions
• Actionable content strategy recommendations

The analysis is generated using artificial intelligence and is intended for educational and informational purposes to help creators improve their content.

3. Account Registration and Responsibilities

To use CreatorVision, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Ensuring your contact information remains accurate and up-to-date

You may not share your account credentials with others or allow multiple people to use a single account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription Plans, Billing, and Minutes

CreatorVision operates on a minutes-based billing system. Each video analysis consumes minutes based on the length of the video being analyzed (rounded up to the nearest minute, with a minimum of 1 minute per analysis).

Free Accounts

New users receive 5 free minutes to try the Service. These minutes do not expire but are non-refundable and non-transferable.

Subscription Plans

• Subscriptions are billed monthly in advance
• Minutes included in your subscription plan refresh at the beginning of each billing cycle
• Unused minutes do not roll over to the next billing period
• You may cancel your subscription at any time; access continues until the end of your current billing period

Pay-As-You-Go

Additional minutes can be purchased on a pay-as-you-go basis. Pay-as-you-go minutes do not expire.

Refund Policy

No refunds will be provided for minutes that have been used. Subscription fees are non-refundable once the billing period has begun. If you believe you were charged in error, please contact us within 14 days of the charge.

5. Acceptable Use

You agree to use CreatorVision only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Submit videos containing illegal content, including but not limited to: child exploitation material, content that promotes violence or terrorism, or content that violates others' intellectual property rights
• Use the Service to harass, abuse, or harm others
• Attempt to reverse engineer, decompile, or extract the source code of the Service
• Use automated scripts, bots, or other means to access the Service without our express permission
• Circumvent rate limits, security measures, or access controls
• Resell, redistribute, or commercially exploit analysis results without our written consent
• Impersonate any person or entity, or falsely state or misrepresent your affiliation
• Interfere with or disrupt the Service or servers connected to the Service

We reserve the right to suspend or terminate your account and refuse service to anyone who violates these acceptable use policies.

6. Intellectual Property

Your Content

You retain all ownership rights to the videos you submit for analysis. By using the Service, you grant us a limited, non-exclusive license to process your submitted video URLs for the purpose of providing the analysis service.

Our Content

CreatorVision, including its name, logo, website, analysis frameworks, AI models, code, and all associated intellectual property, is owned by Pink Llama Creative LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our intellectual property without our express written consent.

Analysis Results

You may use analysis results for your personal content creation purposes. You may share insights from your analyses, but you may not systematically redistribute, resell, or commercially exploit the analysis output.

7. Third-Party Services and Platforms

CreatorVision analyzes publicly available videos from third-party platforms including YouTube, TikTok, and Instagram. Please note:

• CreatorVision is NOT affiliated with, endorsed by, or sponsored by YouTube, Google, TikTok, ByteDance, Instagram, or Meta.
• We access video content and metadata through public APIs and web scraping of publicly available data
• Your use of these third-party platforms is subject to their respective terms of service
• We are not responsible for changes to third-party APIs that may affect Service functionality

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Analysis results will be accurate, complete, or useful for your specific needs
• Any particular content strategy will result in increased views, engagement, or revenue
• The Service will be compatible with all devices or browsers

AI-generated analysis is for informational purposes only and should not be considered professional advice. Results may vary and we make no guarantees regarding specific outcomes.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PINK LLAMA CREATIVE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Termination

Either party may terminate this agreement at any time:

• You may cancel your subscription and delete your account through your account settings
• We may suspend or terminate your account for violation of these Terms, suspected fraud, or for any reason with or without notice

Upon termination:

• Your access to the Service will immediately cease
• Any unused minutes in your account will be forfeited and are non-refundable
• Your analysis history and data will be deleted in accordance with our Privacy Policy

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Service and updating the "Last updated" date. We may also send email notifications for significant changes.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and cancel your account.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Delaware.
